findWellness Reset Terms and Conditions

findWellness Reset is a programme offered by Be Your Best NZ Ltd ("BYB"). By enrolling in findWellness Reset, you agree to these Terms and Conditions.
In these Terms, “you” and “your” refers to the individual accessing and using our services.
Terms apply to all information and advice provided by BYB and Claire Turnbull, including but not limited to that on the findWellness Reset programme, social media, blogs, live events, emails and other communication channels.
1. General Information

2. Eligibility
2.1 You must be 18 years or older or have parental/guardian consent to enrol.
2.2 You agree that all information provided to us is accurate and complete.
3. Programme Overview
3.1 findWellness Reset is a 14-week personalised online wellbeing programme. It includes one-on-one coaching sessions with a Registered Dietitian or Nutritionist, weekly educational content, and digital/physical resources to support your progress.
3.2 Coaching sessions are conducted via video call and links will be emailed to you.
3.3 A welcome pack is sent to you. If you are outside NZ there will be an additional fee to send this to you.
3.4 Programme start dates are flexible; the programme will begin on a Sunday, with your first coaching session to be had during this week.
4. Pricing, Payment and Refunds
4.1 Pricing Options:
You may choose to:
- Pay in full at the time of registration, or
- Pay as you go, which includes a non-refundable initial payment, followed by automatic weekly payments.
4.2 Payment Method:
Payments are processed securely through Stripe. We accept major credit; debit cards and apple pay.
4.3 Confirmation:
You will receive confirmation of your place in the programme via email after your payment is received.
4.4 Failed Payments:
If your payment fails, we reserve the right to suspend access to the programme until payment is resolved.
4.5 Refunds and Cancellations:
We understand that circumstances can change. Refunds (full or partial) are considered on a case-by-case basis and at the discretion of BYB. Please contact us as soon as possible to discuss your situation.
5. Your Responsibilities
5.1 You are responsible for attending scheduled coaching sessions. If you do not attend a coaching session, that session is deemed as a lost appointment. If you need to reschedule your appointment, contact your coach at least 24 hours prior to your appointment via email.
5.2 We recommend a time commitment of approximately 1 hour per week to get the most out of the programme.
5.3 You agree not to share your access, resources, or programme content with others.
6. Health and Medical Disclaimer
6.1 The information on the weekly emails and downloadable resources are generalised information. It is not a substitute for professional personalised medical advice.
6.2 Please consult your GP or relevant health professional if you have any pre-existing conditions or concerns.
6.3 Participation is at your own risk. BYB and your health coach are not liable for any outcomes, injuries, or health issues that may arise during or after your involvement.
7. Privacy and Data Use
7.1 We collect personal information for the purpose of delivering this programme and tracking progress. Your data is handled in line with our Privacy Policy.
7.2 You will receive emails from Claire Turnbull offering ongoing support, tips, and recipes. You can unsubscribe at any time.
7.3 Testimonials may be used for marketing purposes, with personal details anonymised unless explicit permission is given.
8. Intellectual Property
All content, materials, and resources provided as part of findWellness Reset are owned by BYB and protected under New Zealand law. You may not reproduce, share, or distribute any content without written permission.
9. Liability
To the maximum extent permitted by law, BYB disclaims all liability for damages of any kind arising from your use or participation in this programme. Our liability is limited to the total amount you paid.
10. Programme Changes and Termination
10.1 We reserve the right to update or modify the programme at any time. You will be notified of any significant changes.
10.2 We may terminate or suspend access to the programme for breach of these Terms.
11. Governing Law
These Terms are governed by New Zealand law. Any disputes will be resolved in New Zealand courts.
